SPONSOR: The $25,000 Ty Pennington Kitchen Makeover Sweepstakes (the "Sweepstakes") is sponsored by HarperCollins Christian Publishing, Inc. ("Sponsor") c/o Zondervan Books, 3900 Sparks Drive SE, Grand Rapids, MI 49546.
ELIGIBILITY: The Sweepstakes is open to all legal residents of the fifty (50) United States (excluding Puerto Rico and all US territories and possessions and overseas military installations) and the District of Columbia who are eighteen (18) years of age or older as of May 16, 2019. Further, to enter you must be the homeowner at the address entered on the Official Online Entry Form at the time of entry and at time of prize distribution. Employees and immediate family members of Sponsor, Ty Pennington, each of their respective parents, subsidiaries, affiliates, assigns, advertising, promotional and fulfillment agents, attorneys, and other representatives and the persons with whom each of the above are domiciled are not eligible to enter the Sweepstakes or win a prize. Void in Puerto Rico, all US territories and possessions and overseas military installations, and wherever prohibited or restricted by law. Each entrant in the Sweepstakes must be the rightful owner or have authorized use of the email account indicated by the entrant's email address. In the event of a dispute concerning the identity of a prize winner submitting an entry, such prize winner will be deemed to be the person in whose name the email account is opened. The email account must be opened prior to 9:00:00 a.m. (ET) on May 16, 2019. Subject to all applicable Federal, State, local, and municipal laws and regulations.
HOW TO ENTER: The Sweepstakes begins at 9:00:00 AM Pacific Time (“PT”) on May 16, 2019 and ends at 11:59:59 PM PT on June 1, 2019 (“Sweepstakes Period”). All Internet Entries must be received by 11:59:59 PM PT on June 1, 2019. To enter, visit lifetotheextremebook.com/25k or www.typennington.com/25k (the “Web Sites”) and follow the on-screen instructions and complete and submit the Official Online Entry Form as directed. You will be required to provide your (i) complete name , (ii) postal address including zip code and (iii) a valid email address (hereinafter, individually as an “Entry” and collectively as “Entries”). Following successful completion of the foregoing, you will see a confirmation message. This message signifies your Entry has been received for the Sweepstakes. By participating in the Sweepstakes, you may receive by email special offers and mail communications from the Sponsor and from Ty Pennington.com. You can unsubscribe from these promotional emails at any time. Limit one (1) Entry per person or email address during the Sweepstakes Period. Multiple Entries are automatically disqualified; only the first Entry will be considered. Use of any robotic, automatic or macro devices is not valid for Entry. Any Entry that is submitted with the use of a robotic, automated or macro device will be void. All Entries become the property of the Sponsor and will not be acknowledged or returned.
SELECTION OF WINNERS/RANDOM DRAWING: One (1) potential Grand Prize Winner and three (3) potential First Prize Winners will be selected by a random drawing from among the eligible Entries during the Sweepstakes Period. Potential prize winners will be chosen by Sponsor on or about June 3, 2019. Potential Grand Prize Winner will be notified by email and required to execute and return an Affidavit of Eligibility and Liability Release and, where lawful, a Publicity Release within five (5) business days of notification attempt. Each potential First Prize Winner will be notified by email and required to complete and return a Prize Verification Form and, where lawful, a Publicity Release to Sponsor within five (5) business days of notification attempt. If a potential prize winner fails to comply with these Official Rules and/or to submit the required documentation within the designated period, or if a prize winner notification is returned as undeliverable, the potential prize winner will be deemed to have forfeited the prize and the prize will be awarded to an alternate prize winner selected in a random drawing from among all remaining eligible Entries received during the Sweepstakes Period. Sponsor is not responsible for fraudulent calls or emails made to entrants not by the Sponsor. THE ODDS OF WINNING DEPEND UPON THE NUMBER OF ENTRIES RECEIVED DURING THE SWEEPSTAKES PERIOD. LIMIT ONE (1) PRIZE PER HOUSEHOLD.
PRIZES AND THEIR APPROXIMATE RETAIL VALUE (“ARV”): ONE (1) GRAND PRIZE: Grand Prize consists of $25,000 awarded in the form of a check made payable to the Grand Prize Winner to be used towards a kitchen makeover, one (1) in-person interior design consultation at the Grand Prize Winner’s home with Ty Pennington at a date and time designated by Sponsor and subject to Ty Pennington’s availability, and one (1) copy of Ty Pennington’s book titled “Life to the Extreme: How a Chaotic Kid Became America's Favorite Carpenter” (ARV $26.99). The in-person interior design consultation with Ty Pennington portion of the Grand Prize has no cash or retail value. ARV of the Grand Prize is $25,026.99. Grand Prize Winner must own the home in which the kitchen receiving the makeover is located. Grand Prize Winner must allow and be authorized to provide Ty Pennington access to the home at an agreed upon date and time for the in-person interior design consultation or Grand Prize may be forfeited. Prior to the in-person interior design consultation, Sponsor may request a kitchen inspection. Grand Prize Winner must allow and be authorized to provide Sponsor to enter the home for kitchen inspection or Grand Prize may be forfeited. Kitchen makeover consultation must be scheduled no later than 12 months from date of prize award. Grand Prize Winner will receive cash prize only and will be responsible for all aspects of their kitchen makeover including, without limitation, obtaining all designs, permits, contractors and insurance required and their associated costs and any additional costs of the makeover exceeding the prize value. In the event Ty Pennington is not available for the in-person interior design consultation, for reasons including but not limited to scheduling conflict, cancellation, postponement, location change, an event of force majeure, or for any other reason, then Sponsor reserves the right to award the remainder of the prize with no further obligation to the Grand Prize Winner. Grand Prize Winner will be required to supply Sponsor with his/her social security number for tax purposes. Grand Prize Winner will receive an IRS Form 1099MISC for the ARV of his/her prize.
THREE (3) FIRST PRIZES: Each First Prize consists of one (1) piece of promotional canvas photo artwork to be designated by Sponsor (promotional artwork has no cash or retail value) and one (1) copy of Ty Pennington’s book titled “Life to the Extreme: How a Chaotic Kid Became America's Favorite Carpenter” (ARV $26.99). ARV of each First Prize is $26.99.
The total combined ARV of all prizes is $25,107.96. All prizes will be awarded, provided there are sufficient eligible Entries received. Prizes are non-transferable and cannot be sold or redeemed for cash. In the event that a prize or portion thereof is unavailable, Sponsor reserves the right to substitute a cash payment of equal or greater value. Prize winners are solely responsible for all federal, state and/or local taxes and for any other fees or costs associated with the prizes they receive, regardless of whether it, in whole or in part, are used. Sponsor has made no warranty or guarantee in whole or in part, express or implied, in fact or in law, in relation to the use of any prize, including, but not limited to, its quality and merchantability, fitness for a particular purpose or suitability for use. In the event a prize is unclaimed, it will not be awarded.
GRAND PRIZE CODE OF CONDUCT: The conduct of the Grand Prize Winner will be under the supervision of Sponsor and Ty Pennington and staff whose decisions are final and binding in all aspects relating to the in-person interior design consultation. In-person interior design consultation may be terminated at the sole discretion of the Sponsor for any reason at any time, including but not limited to the advice of Ty Pennington and staff, creating an unauthorized disturbance, interruption or unnecessarily rough physical contact, or for any unhealthy, unlawful, unsafe, or inappropriate act. Any act performed by the Grand Prize Winner defined by Federal, State or Local statute or ordinance as constituting a criminal act may result in termination of the in-person interior design consultation. At the sole discretion of the Sponsor and Ty Pennington and staff, if the Grand Prize Winner uses profanity, or demonstrates any lewd or sexually suggestive gestures or full or partial nudity, the Sponsor shall have the right to terminate the in-person interior design consultation. At the sole discretion of the Sponsor and Ty Pennington and staff, if the Grand Prize Winner creates the potential for death, disability, injury and/or property damage during the in-person interior design consultation, the Sponsor and/or Ty Pennington and staff, shall have the right to terminate the in-person interior design consultation. By participating in the in-person interior design consultation, the Grand Prize Winner grants Sponsor the right to videotape his/her participation in the in-person interior design consultation and consents to the use of his/her name, hometown and biographical information, voice, picture, video, image and/or likeness, for advertising, trade and/or publicity purposes without additional compensation in all media now known or hereafter discovered, worldwide and on the Internet and/or World Wide Web, without notice, review, or approval, except where prohibited by law. Grand Prize Winner must not be: (i) represented under a contract (e.g., by a talent agent or manager) either at the time of entry or at any time prior to the in-person interior design consultation; (ii) subject to an acting, modeling or any other contract that would make his/her appearance in the work a violation of any third-party rights; or (iii) under any other contractual relationship, including but not limited to any guild or union memberships, that would in any way limit or impair Sponsor’s ability to display or use his/her name, hometown, biographical information, voice, picture, video and/or or likeness in any media form, in perpetuity on a royalty-free basis, without any payment of fee obligations of any kind.
CONDITIONS: By participating, entrants affirm that they have read these Official Rules, agree to be bound by them and the selection of the prize winners, which shall be final, and waive any right to claim ambiguity in the Sweepstakes and/or these Official Rules. Acceptance of a prize constitutes permission to use the prize winner's name, city and state of residence, photo, video, likeness, persona, biography, comments, and prize won for purposes of commercial advertising, promotion and publicity without additional compensation, except where prohibited or restricted by law. As a condition of entering, entrants agree: (a) to release, forever discharge and hold harmless Ty Pennington, Sponsor, and each of their respective parents, affiliates, subsidiaries, retailers, sales representatives, distributors, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”), from any and all liabilities, losses, injuries or damage of any kind to persons (including death) or property, resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Sweepstakes or any Sweepstakes-related activity, the awarding, receipt, possession, and/or use or misuse of any prize or the substitution of any prize (or any portion thereof) in accordance with the Official Rules; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. In the event the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate, cancel or terminate the Sweepstakes as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prizes from among all valid and eligible Entries received up to the time of such Force Majeure event. Without limiting the foregoing, by participating, the entrants release, discharge, and hold harmless the Released Parties from any and all liability or damages arising from the administration of the Sweepstakes and the use or misuse of any prize received in this Sweepstakes, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible Entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes, and (iii) any damage to the entrant's computer, related equipment, data files, and software resulting from entrant's downloading of information regarding the Sweepstakes or participation in the Sweepstakes. Sponsor reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes should a virus, bug, computer problem or other causes beyond Sponsor's control corrupt the administration, security or proper operation of the Sweepstakes. Sponsor may prohibit you from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking or employing other unfair practices or by abusing other entrants or the representatives of Sponsor.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEB SITES OR UNDERMINE THE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, SPONSOR RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.
Any dispute arising from the Sweepstakes will be determined according to the laws of the State of New York, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Courts located in the State and County of New York over them and agree that such courts have exclusive jurisdiction over all such disputes.
